Terms of Service

1. Accounts & Age Requirements
1.1 You represent that you have the legal capacity to enter into a binding contract. Minors must use the Site under the supervision of a parent or legal guardian, and any purchase must be completed by the guardian.
1.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us promptly at Support@mambobaby.com of any unauthorized use or security breach. 

2. Orders, Pricing & Corrections
2.1 Your order is an offer to purchase. We may accept your offer by sending a shipping confirmation or by shipping the products. We reserve the right to refuse or cancel any order due to stock limitations, pricing or information errors, suspected fraud, or for any reason permitted by law.
2.2 In the event of pricing, availability, or description errors, we may cancel before shipment and issue a refund, or correct the error and request your confirmation to proceed.
2.3 (Optional—B2B) Bulk/wholesale purchases may be governed by separate written terms. If there is a conflict, the signed agreement controls.

3. Payment, Currency, Duties & Taxes
3.1 Accepted payment methods are shown at checkout. All prices are in US and are tax-inclusive or tax-exclusive as indicated at checkout.
3.2 Import duties, taxes, and customs fees may apply in the destination country/region and are the recipient’s responsibility, unless the order is clearly marked Delivered Duty Paid (DDP).
3.3 Any currency conversion or processing fee is determined and charged by your card issuer or payment processor.

4. Shipping, Delivery & Risk of Loss
4.1 Typical order processing time is 2-3 business days. Holidays and peak seasons may extend processing times.
4.2 Unless otherwise required by applicable law, risk of loss transfers to you when we deliver the goods to the carrier.
4.3 Delivery dates are estimates only and are not guaranteed. Delays caused by carriers, customs, or events beyond our control do not constitute a breach.
4.4 (Product Safety Notice—if applicable) Our water-related products are not life-saving devices. Use only as directed and under competent adult supervision.

5. Prohibited Uses
You may not use the Site or services to (including but not limited to):

• Violate any applicable law or regulation;
• Infringe intellectual property, privacy, or other rights;
• Upload or transmit malware, malicious code, or interfere with security or operation of the Site;
• Circumvent, probe, scan, or test any system or network vulnerability or authentication measures;
• Engage in fraud, deception, fake orders, scraping that degrades service, or other abusive activity.
• We may suspend or terminate access, and pursue remedies, if we reasonably believe a violation occurred.
  

6. User-Generated Content (UGC) License
6.1 By submitting reviews, photos, videos, or other content (“UGC”), you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, modify, publish, translate, distribute, display, and transmit your UGC in any media for marketing, promotion, and operation related to our products and services.
6.2 You represent that you own or have the necessary rights to the UGC and that the UGC does not infringe any third-party rights or contain unlawful content.
6.3 You may withdraw your future UGC license by emailing Support@mambobaby.com; withdrawal does not affect uses made prior to our processing your request.

7. Limitation of Liability
To the fullest extent permitted by law:
7.1 We are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of the Site or products.
7.2 Our aggregate liability for any claim is limited to the amount you actually paid for the order giving rise to the claim.
7.3 Nothing in these Terms limits liability for our willful misconduct, gross negligence, or any liability that cannot be limited under applicable law.

8. Changes to These Terms
We may update these Terms from time to time and will indicate the “Last Updated” date above. Updates take effect upon posting. Your continued use of the Site constitutes acceptance of the updated Terms.

9. Miscellaneous

9.2 Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
9.3 No Waiver. A failure to enforce any provision is not a waiver of that provision or any other provision.
9.4 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in compliance with applicable law.
